STATE OF GEORGIA COUNTY OF SPALDING NOTICE OF SALE UNDER POWER Because of a default in the payment of the indebtedness secured by a Security Deed executed by Miguel A. Gonzalez to Mortgage Electronic Registration Systems, Inc. dated December 15, 2004, and recorded in Deed Book 2610, Page 213, Spalding County Records, said Security Deed having been last sold, assigned, transferred and conveyed to Wells Fargo Bank, NA, by Assignment, , securing a Note in the original principal amount of $70,847.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, September 4, 2012, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit: All that lot, tract or parcel of land situate, lying and being in Land Lot 113 of the Second District of originally Monroe, now Spalding County, Georgia, and in the City of Griffin, and being more specifically designated as being the east portion of Lot 5 in Block 2 of the G. T. Pursley Subdivision of the Gresham Heights Property, as shown on a plat of survey dated July 30, 1925, made by N. S. Westbrook, C.E., a copy of which said plat is recorded in Plat Book 1, page 14, of the Spalding Superior Court records, and which said plat is hereby incorporated in and made a part of this description by reference. The said east portion of said Lot 5 in Block 2 may be more particularly described from the aforesaid plat as follows: BEGINNING at a point on the west property line of North 17th Street, which point of beginning is located north 160 feet, as measured along said west property line, from the point of intersection of said west property line with the north property line of Wright Street; and running from said beginning point north, along said west property line. 52 feet; thence west, of even width, 150 feet. Said lot is bounded as follows: Northerly by a portion of Lot 6, in said Block 2; Easterly by North 17th Street; Southerly by Lots Nos. 1, 2 and 3 in said Block 2; and Westerly by the remaining portion of said Lot 5, in said Block 2. Located on said lot is one, one-story, four-room frame dwelling in the City of Griffin. Said property is known as 313 North 17th Street, Griffin, GA 30223, together with all fixtures and personal property attached to and constituting a part of said property, if any. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed. Notice has been given of intention to collect attorney's fees in accordance with the terms of the Note secured by said Deed.
